01About these terms
These Terms & Conditions apply to your use of this website and to the services provided by MD Telematics, Near Laal Ji's Temple, Mehta Hospital Road, Balotra (344022), Rajasthan, India (“we”, “us”). By using the website or ordering a service, you agree to them.
The scope, price and timeline of each service are set out in our written quote, proposal or invoice. If anything in that document differs from these terms, the document agreed for your project applies.
02Quotes and payments
- Prices are in Indian Rupees (INR). GST and other applicable taxes are added as required by law.
- Quotes are valid for 15 days unless they say otherwise.
- Unless agreed differently, work starts after the advance payment stated in the quote is received.
- Prepaid credits (such as SMS or voice credits) and amounts already paid to third parties on your behalf — for example advertising budgets, domain names or app-store fees — cannot be refunded once used or paid.
- We may pause a service if an invoice is unpaid after its due date, after giving you notice.
03Your responsibilities
- Give us accurate information and the content, approvals and account access we need, on time.
- Make sure you own, or have permission to use, the logos, images, text, music and data you send us, and that they do not break any law or anyone's rights.
- Keep your own passwords and accounts secure, and tell us about any change that affects our work.
- Review and approve designs, content and campaigns before they go live.
04Bulk SMS, voice calls and WhatsApp
Messaging is regulated in India. When you use our SMS, voice, IVR or WhatsApp services, you agree to:
- follow the TRAI Telecom Commercial Communications Customer Preference Regulations, 2018 and DLT requirements, including registering your entity, sender IDs (headers) and message templates;
- send messages only to people who have agreed to receive them, and respect Do-Not-Disturb preferences;
- never send spam, fraudulent, misleading, offensive or illegal content, and follow WhatsApp's Business and Commerce policies.
Delivery depends on telecom operators and platforms, so we cannot guarantee that every message or call is delivered. We may suspend sending, without refund, if we believe content breaks the law or these terms. You are responsible for the content you send and the consent of your recipients.
05Advertising and online platforms
- Google, YouTube, Meta (Facebook, Instagram, WhatsApp), Apple and other platforms have their own rules. Your accounts, ads, apps and pages must follow them.
- Approvals, verifications, rankings, reach, leads and sales depend on these platforms and on the market, so we do not guarantee specific results — we guarantee to do the agreed work carefully and report honestly.
- Advertising budgets are paid to the platforms and are separate from our fees, unless your quote says otherwise.
- We are not responsible for account suspensions, policy changes or outages caused by these platforms.
06Websites, apps, graphics and video
- Each project includes the revision rounds stated in the quote; extra changes may be charged separately.
- Once you have paid in full, you own the final designs, videos, website and app content made for you. Third-party items (fonts, stock images, music, plugins, libraries) remain under their own licences.
- Publishing on the Apple App Store or Google Play depends on their review, which we cannot guarantee. Developer account, domain and hosting fees are payable by you unless included in your plan.
- We may show completed work in our portfolio unless you ask us not to in writing. Confidential details are never shown.
07AI and automation services
- AI chatbots, voice agents and content tools can make mistakes. Please review AI-generated content before publishing, and keep a person available for important decisions and complaints.
- You are responsible for telling customers when they are talking to an AI assistant where required, and for having consent to contact them.
- Automations depend on the third-party services they connect (for example WhatsApp, Google Sheets or your CRM). We are not liable for failures or changes in those services, but we will help fix affected automations under your support plan.
08Using this website
You may browse this website and contact us for genuine enquiries. You must not misuse it — for example by sending spam through our forms, trying to access the admin area, or disrupting the site.
The MD Telematics name, logo, text and design of this website belong to us. Product names and logos of other companies (such as Google, Amazon or Apple) belong to their owners and are used only to describe our services. Links to other websites are for convenience; we are not responsible for their content.
09Confidentiality and data
We keep your business information confidential and use it only to deliver your services. How we handle personal data is explained in our Privacy Policy.
10Limitation of liability
We provide our services with reasonable skill and care. To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits or business interruption, and our total liability for any claim is limited to the fees you paid us for the specific service concerned in the three months before the claim.
11Ending a service
Either party may end a service by written notice as set out in your quote or plan. You pay for work done and costs already incurred up to that date. We may stop a service immediately if it is used for illegal or abusive purposes.
12Governing law
These terms are governed by the laws of India. Any dispute will first be discussed in good faith; if it cannot be resolved, the courts at Balotra, Rajasthan will have exclusive jurisdiction.
13Changes to these terms
We may update these terms from time to time. The “Last updated” date shows the current version. Terms that apply to an ongoing project are those agreed when it started, unless we both agree to a change.
